Overview
This SMS Terms & Opt-In Policy ("SMS Policy") governs the sending and receipt of text messages (SMS) by Agentifiq and by businesses ("tenants") using the Agentifiq platform to communicate with their end users. It applies to all SMS programs operated through Agentifiq's AI Receptionist, contact form widgets, and any other platform feature that sends or receives SMS messages.
Agentifiq operates as both a direct sender in certain programs and as a platform provider enabling tenant businesses to send messages to their own customers. This policy addresses both roles. All SMS messaging conducted through Agentifiq's platform complies with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act (where applicable), CTIA Messaging Principles and Best Practices, and carrier guidelines for 10DLC (10-Digit Long Code) messaging.
By providing your mobile phone number and opting into any Agentifiq SMS program, you agree to the terms set forth in this policy.
Program Description
Agentifiq operates two primary SMS programs through its platform:
Program 1: AI Receptionist SMS
When a tenant business deploys Agentifiq's AI Receptionist for their operations, the AI Receptionist may send SMS messages to callers and contacts on behalf of that tenant. These messages serve operational and relationship purposes and may include:
- Appointment reminders sent before a scheduled meeting or service
- Booking confirmations sent after an appointment is scheduled through the AI Receptionist
- Follow-up messages sent after a call or service interaction
- Requests for additional information needed to fulfill a service inquiry
- Rescheduling notifications if an appointment is moved or cancelled
In this program, the tenant business is the message sender and is responsible for obtaining proper consent from their end users before those users are enrolled in AI Receptionist SMS communications. Agentifiq provides the infrastructure and delivery mechanism; the tenant is the principal behind the messaging.
Program 2: Contact Form Inquiry Follow-Up
When you submit a contact form on a website powered by Agentifiq's engagement widgets, you may be asked to provide your mobile phone number and to explicitly opt in to receiving SMS follow-up communications. This opt-in is always voluntary and separate from form submission. You will not be enrolled in SMS communications simply by submitting a contact form without affirmatively checking an opt-in checkbox or otherwise clearly indicating your consent.
Contact form SMS messages may include responses to your inquiry, requests for clarification, and status updates regarding your request.
How to Opt In
Opt-in to Agentifiq SMS programs occurs through one or more of the following methods:
- Web form opt-in: You check a clearly labeled checkbox on a contact or registration form that states you agree to receive SMS messages. The checkbox is unchecked by default and you must affirmatively select it.
- Verbal opt-in via AI Receptionist: During a call handled by the Agentifiq AI Receptionist, you may verbally consent to receive follow-up SMS messages. Your consent is recorded in the call summary.
- Text-to-join keyword: Where a keyword program is configured by a tenant, you may opt in by texting a designated keyword (such as JOIN) to the tenant's business number.
By opting in through any of these methods, you confirm that:
- You are the owner or authorized user of the mobile number provided
- You are at least 18 years of age
- You consent to receive automated text messages at the mobile number provided
- You understand that consent is not a condition of purchase or service
Message Frequency
Message frequency varies. You may receive up to 10 messages per month depending on your service configuration, the nature of your inquiry, and the number of active appointments or bookings associated with your account. Typical message volumes are lower than this maximum.
For AI Receptionist programs, messages are transactional in nature and are sent in response to specific events (such as a booking being made or an appointment approaching). For contact form programs, messages are conversational and limited to the duration of an active inquiry.
Agentifiq's platform automatically closes SMS conversations after a period of inactivity and will not send unsolicited outreach to opted-in users who have had no recent interaction.
Message & Data Rates
Message and data rates may apply. Standard SMS rates charged by your wireless carrier will apply to all messages you send and receive through Agentifiq programs. Agentifiq does not charge a separate fee for sending or receiving SMS messages through our platform, but your carrier's standard messaging rates apply.
If you are on a limited messaging plan with your carrier, messages sent and received through Agentifiq programs will count toward your plan's message allotment. Contact your wireless carrier for details about your specific plan and applicable rates.
Agentifiq is not responsible for any charges imposed by your wireless carrier in connection with your participation in any SMS program.
How to Opt Out
To opt out at any time, reply STOP to any message from us. You will receive a single confirmation message acknowledging your opt-out request, and no further messages will be sent to your number from that program. The confirmation message reads:
"You have been unsubscribed from Agentifiq SMS messages. No further messages will be sent. Reply START to re-subscribe."
Additional opt-out keywords that our system recognizes include: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT. Any of these keywords, sent as the sole content of a message, will trigger the opt-out process.
Opt-out requests are processed immediately and take effect before any queued messages are sent. If you have received a message in transit at the time of your opt-out, it may still be delivered, but no subsequent messages will follow.
If you opt out of one tenant's SMS program through Agentifiq, your opt-out applies to that tenant's program only. If you interact with a different business that also uses the Agentifiq platform and you have separately consented to that business's SMS program, those messages are governed by a separate opt-in and will continue unless you separately opt out.
You may re-subscribe at any time by replying START or YES to a message from our number, or by opting in again through a web form.

To get help, reply HELP to any message. You will receive a response with basic program information and a support contact. The HELP response reads:
"Agentifiq SMS: For help, visit agentifiq.com or email support@agentifiq.com. Reply STOP to unsubscribe. Msg & data rates may apply."

Supported Carriers
Agentifiq's SMS programs are supported on most major US wireless carriers. Messages may be sent and received by subscribers of the following carriers, among others:
- AT&T
- T-Mobile (including former Sprint subscribers)
- Verizon Wireless
- Boost Mobile
- US Cellular
- Cricket Wireless
- MetroPCS
- Google Fi
- Mint Mobile
- Consumer Cellular
- Straight Talk Wireless
- Xfinity Mobile
This list is not exhaustive. Agentifiq's messaging infrastructure is compatible with most major US carriers. Carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to carrier network availability, coverage, and capacity. Agentifiq is not responsible for messages that are delayed, undelivered, or truncated by carrier networks.
Message delivery may be affected by carrier filtering systems that identify and block spam or unwanted messages. If you believe legitimate messages from an Agentifiq program are being blocked by your carrier, contact your carrier directly or reach us at support@agentifiq.com.
Platform and Tenant Roles
Agentifiq operates in a dual capacity with respect to SMS messaging, and this distinction is important for understanding who is responsible for what:
Agentifiq as Platform Operator
Agentifiq provides the technical infrastructure, carrier connectivity (via registered 10DLC campaigns), software interfaces, and compliance tooling that enable SMS messaging. As the platform operator, Agentifiq:
- Registers 10DLC phone numbers and messaging campaigns with The Campaign Registry (TCR)
- Implements technical controls to honor opt-out requests platform-wide
- Enforces messaging rate limits and content policies
- Maintains records of opt-in and opt-out events at the platform level
- Provides tenants with compliant opt-in UI components and consent language
Agentifiq does not independently initiate SMS campaigns to consumer lists. All outbound SMS activity is triggered by tenant configuration and user-initiated events.
Tenants as Message Senders
Businesses that subscribe to the Agentifiq platform ("tenants") are the principal senders of messages delivered through our infrastructure. As message senders, tenants are responsible for:
- Obtaining valid, documented, prior express written consent from their end users before enrolling them in any SMS program
- Ensuring their consent collection methods meet applicable TCPA, state law, and carrier requirements
- Maintaining records of consent for a minimum period of 5 years
- Ensuring their messaging content is lawful, accurate, and does not violate Agentifiq's Acceptable Use Policy
- Promptly processing opt-out requests received through channels outside of Agentifiq's automated system (e.g., opt-outs received by phone or email)
- Ensuring their use of AI Receptionist SMS complies with applicable state and federal telemarketing laws
Agentifiq provides tenants with compliance resources, consent templates, and platform controls to assist with these obligations, but the legal responsibility for end-user consent rests with the tenant as the message sender. Tenants acknowledge these responsibilities in Agentifiq's Terms of Service and Master Subscriber Agreement.
Privacy
Mobile phone numbers collected through Agentifiq's SMS programs are used exclusively for the purpose for which they were provided. We do not sell, rent, lease, or share mobile phone numbers with unaffiliated third parties for their marketing purposes.
Phone numbers are shared with our telecommunications provider solely for the purpose of delivering SMS messages and are handled in accordance with that provider's data processing agreement. We retain opt-in records, message logs, and opt-out records as required by applicable law and carrier guidelines.
